Miranda Warnings.

Most Americans mistakenly believe that a police officer must give them Miranda Rights before questioning. This is unfortunately wrong. The Miranda warnings must only be given once the suspect is "detained" and is not free to leave, or is under arrest ( i.e. in the back of a police cruiser) or in handcuffs. Unfortunately, many defendants respond to questioning from police officers who make a point to tell them: "they are free to leave at any time" and thus no Miranda warnings are required. Once a confession is obtained, the person is not surprisingly, charged with the crime. Do not fall for this trap. In most cases, you are only required to identify yourself, give your address, and ID card (if you have one), and then politely decline to answer any more questions without a lawyer present.
